The Fear Factor Is Lew Dickey
By Jerry Del Colliano The trades recently bandied about Cumulus CEO Lew Dickey’s aptly coined phrase, “The fear factor is quickly leaving the system”. Dickey was apparently referring to sluggish advertising and his “optimism” that “The mood today versus a year ago has dramatically improved and all of the small businesses that we’re calling on across the country are feeling more optimistic. The result is people are starting to think proactively about growing their business and marketing again.” What they left out was that Lew Dickey is the "Fear Factor". Damn! I know Captain Lew is the darling of radio convention panels. That he loves to spew his Harvard-inspired reinvention of the wheel strategies in making radio into a Dickey-approved entity, but stop already. This guy is an exterminator! Lew Dickey brags about reducing his work force by 6% over the past year – not to mention previous years. He has, according to a class action lawsuit against his company, forced employees in California (and perhaps elsewhere) in essence to work for free. And when it is not for free, it’s next to nothing once you factor in the extra time voice tracking stations, after-hours responsibilities that are expected and failure...

Senator Kerry Blames Talk Radio for Changing Views of Global Warming
If the public doesn't seem as concerned or sold on Global Warming as of late, don't blame the guy who hacked into computers at a British university and grabbed documents which show scientists have attempted to suppress the full story. Blame Talk Radio if you're Senator John Kerry. Jeff Poor writes at Newsbusters.org: "...it's not ClimateGate - but the messenger who is at fault for growing hesitation to enact a cap-and-trade policy," according to Kerry. He quotes the Senator as saying, "The science 'has been maligned and misinterpreted, and we need to fight back . . . people [need to] stop being moved by these talk show [hosts]'". Spanish Broadcasting System, Inc. Reports Results for the Fourth Quarter and Fiscal Year 2009 (GlobeNewswire)
COCONUT GROVE, Fla. -- Spanish Broadcasting System, Inc. today reported financial results for the fourth quarter and fiscal year ended December 31, 2009.
TiVo Beats on Higher Revenues
Zacks.com submits: TiVo Inc. (TIVO) reported a net loss of 9 cents per share for the fourth quarter of fiscal 2010, 3 cents above the Zacks Consensus Estimate of a loss of 12 cents per share but fell from the prior-year quarter. The company had reported a loss of 4 cents per share in the fourth quarter of 2009. Although revenue growth was encouraging in the quarter driven by higher hardware sales, growing costs and reduced subscriber additions led to lower profitability. TiVo is not immune to the current challenging economic environment and is facing erosion of its subscriber base. Complete Story
Radio revenues down 9% for Spanish Broadcasting System in the latest quarter
TV revenues looked much worse, percentage-wise – down 27% from the year before. But they're a much smaller part of the Miami-based SBS, accounting for $4.3 million in revenue in the fourth quarter of 2009. While radio was about $31.6 million, down from $35 million. Operating income from both divisions was better: Radio’s improved from $12.6 million to $13.8 million and the operating loss for TV dropped from $5.6 million to $825,000. Looking just at radio, the company says local revenue trended down in all its markets. Like many other radio operators, Spanish Broadcasting System conducted an impairment test on the carrying values of its FCC licenses, and took a non-cash write-down of $8.5 million in the fourth quarter. The company remains listed on the NASDAQ, thanks to a reprieve granted following a special meeting with the exchange on January 7. It has until June 7 to get the stock price for “SBSA” back above $1 a share. It closed unchanged at 80 cents today (3/10), before the market saw the quarterly and full-year results. RAIN 3/10: Tomorrow, CBS turns off ALL streaming outside U.S.
CBS RADIO MAKES IT OFFICIAL AND BLOCKS NON-U.S. LISTENING TO ALL STREAMS In February (here) we reported CBS Radio had begun blocking online streams to non-U.S.-based listeners. CBS’s official stance was the move was to avoid complex and costly international royalty requirements, though at the time we questioned why they’d cut off access to non-music stations (news, talk, sports, etc.), which don’t incur music royalties. Tom Taylor reports today that CBS, in fact, hadn’t cut off the non-music streams (an “unexpected reprieve” he called it), but the broadcaster is doing it now. Beginning tomorrow, CBS Radio’s news, talk, and sports station streams will be “geo-blocked” to prevent non-U.S. listening. Taylor quotes an internal CBS memo: “This project effectively disables all non-U.S.-based consumers from accessing content via the AOL, Yahoo! and CBS streaming networks“ (so, presumably, this means Internet-only streams from AOL Radio and Yahoo! Radio, which are operated by CBS). Foreign listeners trying to access a CBS stream will get a message (Taylor reports, again quoting the memo) “directing them to our sister property Last.fm.” Last month we suggested that — while the complexities presented by trying to navigate royalty requirements in every country in which listeners might be located are...

A Nova Scotia station is in trouble after poking too much fun at local politicians
The contest on CFRQ-FM (104.3) in Halifax, Nova Scotia asks listeners how much a certain fictitious politician by name has absconded with, saying on the air “Now is your chance to be the only Nova Scotia taxpayer to benefit from the slimy douche-baggery of Richard the frugal MLA.” The promotion by CFRQ features a photo of a man in a suit lighting a cigar with a $100 bill, according to the CBC, and offers listeners a chance to win as much as $20,000 and a trip to Cuba. However, not everyone is happy with the promotion. The CBC says at least one advertiser has pulled ads from the station in response to the contest, saying the fictitious character bears the same name as a former area politician. You can view the contest on “Q-104” by clicking here. You can listen to CFRQ here.

Has anyone ever heard them call a male's name? I mean, I know the station is aiming squarely at females but to pretend no males registered for the contest is crazy. And also because today, I couldn't tell whether the 1:00 name was "Tiff" or "Tim." The Basics of Music Licensing in Digital Media - Videos, Podcasts, Commercials, Downloads, Fair Use - What Questions Should You Be Asking?
Broadcasters need to be aware that ASCAP, BMI and SESAC (the "performing rights organizations" or PROs) don't cover them for all uses of music - especially uses that may be made on station websites. Offering downloads, podcasts, and streaming video featuring music all require specific permission from music rights holders. And,as we wrote just last week, incorporating music into recorded commercials alsorequires specific permission from rights holders - not just your routine payment to the PROs. As music usually has two different classes of rights holders - those that hold the rights to the musical composition (the lyrics and music in the song, usually held by a publishing company), and the rights to the "sound recording" or "master recording" (usually held by the record companies), knowing who to ask for what rights can sometimes be complicated. To help explain some of the basic issues of where to go for what rights, Davis Wright Tremaine has put together a Guide to the Basics of Music Licensing, available here. The Guide also addresses some of the controversial issues in music licensing, and the question of "fair use", a concept often cited but also often misunderstood. So check out ourGuide for a basic introduction to...

Oklahoma City's "Jack FM" is gone, replaced by country KKNG
After four years, owner Tyler Media blows up classic hits “Jack FM” KOJK, Blanchard OK (97.3) to make 97.3 the new home of country KKNG, which moves up the dial from 93.3. For now, the Oklahoman says Tyler will simulcast the two signals. But eventually there will be a new format at 93.3, and KKNG will survive at 97.3. The Blanchard-licensed 97.3 is a lesser facility: a Class A compared to the Class C1 signal at 93.3, licensed to Newcastle. Another change on Tuesday was the laying off of KKNG morning personalities Bill Thomas and K.C. Sheperd plus PM driver James Ayers. Manager Ty Tyler says Lynn Waggoner will continue in mornings, and says KKNG will focus on “traditional country.” He didn’t drop any hints about the future of 93.3. The Oklahoma Board of Radio-Info is speculating about that, and the mysterious registration of “933TimFM.com.” That thread is here.

Today show and New York Times profile Scientology defector
The Today show this morning presented a live interview with a woman who left the Sea Organization, the group which keeps the Church of Scientology running. Piggybacking off a feature on the woman, Christie King Collbran, which was published in the New York Times on Sunday, the interview featured questions from host Matt Lauer about the circumstances of her departure from the church and the things she saw which convinced her to leave. Like some Scientologists featured in the St. Petersburg Times' stories on the Church, Collbrand said she believed in the teachings of the religion but felt the church was not served well by its current leadership. Few details in the Today interview or New York Times story will be new to readers of the St. Petersburg Times; the allegations of behind-the-scenes abuse by church leaders, convoluted processes to leave and feelings of disenchantment by longtime members have been detailed in our ongoing series of reports since last year, The Truth Rundown.
