Reminder: Closed Captioning Contact Information Due March 22

Requirement applies to all VPDs, even those exempt from captioning requirements As we reported last month, the process for registering complaints about closed captioning problems has kicked in.�And as part of that process, video programming distributors (VPDs) are required to provide to the FCC, by March 22, 2010, contact information (phone/fax/email) so that the FCC will know how to get in touch with the VPD relative to incoming complaints.�VPDs can upload their contact information directly to the FCC by going to the designated page on the FCC’s website (which can be accessed by clicking this link), entering their FRN and FRN password, and then providing the necessary information. Heads up: all VPDs are expected to upload their contact information, even if they happen to enjoy one or another exemption from the captioning requirements.�The universe of VPDs subject to the Commission’s closed captioning requirements encompasses all broadcast television stations, including Class A’s and LPTVs.�Some VPDs fall under certain exemptions which relieve them from having to caption programming that is not otherwise captioned.��(For example, VPDs are not required to caption programming if that captioning would cost more than two percent of the VPD’s gross revenues.�Similarly, VPDs aren’t required to spend any money to...

The Price of Stealing Music (When Caught) Is Coming Down

By Jerry Del Colliano I’ve been saying for a long time now that the record labels through its lobby group RIAA should back off of trying to win lawsuits against consumers for stealing music. I’ve even said that maybe the labels should pay consumers to steal it, spread it virally for them without any further expense to the labels and make them money. After all, much of the credible research on music piracy shows that filesharing does not have the deleterious effect on selling music that the labels claim. Actually, the labels are the main reason they are losing money. Their misguided mergers, denial regarding the digital age and penchant for maintaining the status quo by suing the pants off of everyone they can. So, we know there are many cases out there in the court systems of this country in which the RIAA is trying to win or uphold large penalties for stealing even a little bit of music. That will set a good example for filesharers, they argue. Keep in mind that the music industry has had no reliable way of battening down the Internet to prevent illegal filesharing. "P&G is on an innovation tear. It will have 30% more new products in core categories in 2010 than in 2009." In fact, innovation and expansion into new markets are the two primary ways P&G sees itself growing in the years to come. Recently I was asked about new formats in the US Radio market. I shrugged, because it seems to me that the hottest new formats in the US are the ones happening off the air and on the Internet. While we can conclude that innovation costs and is risky (all true), we must also take a lesson from P&G and conclude that without innovation there is no news, and without news there is no buzz.  And without buzz there is no enthusiasm.  And it's enthusiasm that makes all the other things we want happen. We gripe that audiences and media obsess on platforms with far less universal usage than radio enjoys. But that obsession is a result of their novelty, not in spite of our ubiquity.  That obsession happens because people - all people - naturally gravitate to what's fresh.  Try to Google "iPad first day pre-order sales" for verification. New York Yankees find a long-term home on Spanish-language WADO (1280)

It’s a multi-year deal through Yankees radio flagship WCBS (880), and brings all 162 regular-season games – and all its post-season games – to Univision’s WADO. First game is the season-opener with the Boston Red Sox, from Fenway Park. WCBS GM Steve Swenson calls 30-year New York sportscaster Beto Villo “the premier Spanish baseball broadcaster in the country.” Univision station manager Carey Davis is “thrilled to welcome the Yankees” and their heritage of 27 world championship titles to WADO. New faces on Arbitron's expanded Radio Advisory Council

To give a greater voice to diary-rated markets, the ratings service adds four new seats. Those are being taken by Erik Hellum of GAP West Broadcasting; Frank Osborn of Qantum; Craig Jacobus of South Central Communications; and Dan Savadove of Main Line Broadcasting. There’s also a new PPM set, to be taken by Greater Media Philadelphia manager John Fullam. Plus additional positions for Network Radio (David Landau of Dial Global), Digital Radio (Deb Esayian of Emmis Interactive), and Public Radio (Bill Davis of Southern California Public Radio). Urban and Spanish representation is beefed up by adding Deon Levingston of Inner City Broadcasting and Jeff Liberman of Entravision. Arbitron also re-stocks the Council with replacement reps for a Spanish language seat (Univision Radio President/COO Gary Stone) and Research (Amy Vokes of Radio One). The Council’s next meeting is May 11-12 in Annapolis, MD, near Arbitron’s headquarters in Columbia, MD.

Google’s Coming to the Living Room

Fresh from its growing success on the mobile platform with the Android operating system in Motorola and HTC devices and its market now numbering up to 35,000 apps, Google is retargeting the TV in the living room. Along with partners Sony, Intel and Logitech, Google will be bringing new functionality to the increasingly versatile home TV set by adding another set top box and peripheral devices like speakers and keyboards. According to an article in today’s New York Times, the goal is both to bring web functionality such as Youtube videos, Google search, Twitter social networking and using Picasa for managing photos. Presumably, “Google TV” would be a Chrome-like browser experience for the user. Of course, Google has been trying to find a foothold in the television business by managing and selling local advertising inventory. While this has not made much of an impact to date, the company certainly has the resources to keep at it. Radio ad spending falls 20% in 2009, with national ads worse, says Kantar Media

The report by Kantar Media shows overall advertising was down 12.3% in 2009 from a year prior, and fourth quarter 2009 was down just six percent from the same time in 2008. However, when you break the numbers down, radio advertising was below the overall average, down 20.3% for the year, and 12.5% for the fourth quarter. The Kantar report adds local radio advertising was down 20.6% for the year, and national spot ads even worse, down 24.6%. Network radio advertising fell just 8.7% for 2009. The only sectors to show any increase was internat advertising, up 7.3%, and Free Standing Inserts for coupons was up 3%. Overall, Procter & Gamble was the largest advertiser, as they were in 2008, but spending was down 15.6% compared to a year ago. See the complete report here.

American Idol recap: Lacey Brown ejection shows viewer votes may be back on track

After a few weeks of surprise ejections and odd choices, American Idol viewers seemed to get their mojo back this week -- sending shaky-voiced church singer Lacey Brown home Wednesday just two weeks too late. St. Petersburg-raised Michael Lynche also survived another week, thanks to a powerful rendition of the Rolling Stones' hit Miss You on Tuesday that amped up the song's R&B flavor and gave him plenty of room to work the stage. At a time when even judge Kara DioGuardi is expressing her affection for the 300-pound singer on the Tonight Show and producers count on him to open or close most every broadcast, Lynche's only remaining problem may be the one faced by every Idol front runner: losing the audience's interest by the contest's end (just ask Danny Gokey). Sirius XM Radio Inc. has received a notice of de-listing from the Nasdaq stating that it is not in compliance with the $1.00 minimum closing bid price requirement for continued listing on the exchange, the company said late Wednesday. “We are committed to remaining listed on The NASDAQ Global Select Market,” said Mel Karmazin in a statement. Sirius XM said it will request a hearing before a Nasdaq Listing Qualifications Panel to ask for continued listing pending its return to compliance. “Sirius XM is one of the most liquid securities on The Nasdaq Global Select Market,” added Karmazin. “We have a large investor base consisting of both individual and prominent institutional stockholders; and our equity capitalization is greater than approximately 92% of the companies listed on The Nasdaq Global Select Market.” Over the weekend, the Nasdaq OMX Group announced that Sirius XM’s common stock will be added to the Nasdaq Q-50 Index effective with the market open on Monday, March 22nd.
